These Terms and Conditions govern your use of the services provided by 09 Build, located at 3059 Grand Avenue, Suite 210, Miami, FL 33133 ("Company", "we", "us", or "our").

2. Services

09 Build provides impact window and door installation, kitchen and bath remodeling, and related construction services in South Florida. By requesting a consultation or submitting a form on our website, you agree to be contacted by our team regarding your project.

3. Promotional Offers

Promotional rates, including 0% interest financing offers, are subject to credit approval and available for a limited time. Rates and terms may change without notice. Contact us for full financing details.

4. Text Message Communications

Our forms ask for two separate text message permissions, and you may give either, both, or neither. Transactional and informational messages cover things such as appointment confirmations, account notifications and customer support. Promotional and marketing messages cover offers and updates. Neither is a condition of receiving an estimate or any other goods or services from 09 Build. Messaging frequency may vary and message and data rates may apply. Reply HELP for assistance or STOP to opt out; STOP ends both categories. We do not sell or share your text message consent with anyone.

5. Artificial Intelligence and Third-Party Website Features

Our website incorporates features supplied by Elfsight, a third-party technology provider (or any successor provider we may engage). These features include an automated chat assistant powered by artificial intelligence, and widgets that display customer reviews and ratings sourced from Google and the Better Business Bureau, together with links to our social media profiles.

By accessing or using our website, you acknowledge and consent to the use of artificial intelligence in connection with your use of the site, and to the loading of third-party content and the transmission and processing of related information by Elfsight. If you do not consent, please do not use the chat assistant; you may contact us instead by the telephone number or email address in Section 9.

5.1 Automated chat assistant. The chat feature generates responses using artificial intelligence and is operated on our behalf by Elfsight. You acknowledge and agree that:

Responses are generated automatically. Content produced by the chat assistant is generated by artificial intelligence, is provided for general informational purposes only, and may be incomplete, inaccurate, or out of date. It is not professional, engineering, legal, or financial advice, and it is not reviewed by a person before it is shown to you.
Nothing generated is binding. No statement produced by the chat assistant constitutes a quote, estimate, warranty, scheduling commitment, or offer capable of acceptance, and no such statement creates a contract between you and 09 Build. Pricing, availability, and scope of work are established only in a written agreement signed by an authorized representative of 09 Build.
Information you submit is shared with the provider. Information you enter into the chat assistant is transmitted to and processed by Elfsight and may be retained by Elfsight in accordance with its own terms and privacy practices. You should not submit sensitive personal information, including financial account numbers, government identification numbers, or health information, through the chat assistant.
A human alternative is always available. You are never required to use the chat assistant to obtain information about, or to request, our services.

5.2 Review, rating, and social media widgets. The review and rating widgets display content published by third parties on Google and the Better Business Bureau. That content is authored by its respective reviewers and not by 09 Build, is reproduced as supplied by those platforms, and may be updated or removed by them at any time. Ratings shown reflect the reviews available to those platforms at the time of display and are not a representation by us as to future performance. Because these widgets are loaded from Elfsight, your browser communicates with Elfsight and its content delivery network when you view pages containing them, and technical information such as your IP address and device details may be received by those services.

Information collected through these features is otherwise handled in accordance with our Privacy Policy. We reserve the right to change, suspend, or discontinue any of these features, or to change the provider that supplies them, at any time and without notice.

6. Limitation of Liability

09 Build shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or services. Our total liability shall not exceed the amount paid for the specific service in question.

7. Privacy

Your personal information is handled in accordance with our Privacy Policy. We do not sell your data to third parties.

8. Governing Law

These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in Miami-Dade County, Florida.
